The NFL severely punished the Miami Dolphins leadership for contacting Tom Brady on two occasions, when the quarterback was under contract with the New England Patriots and Tampa Bay Buccaneers, between 2019 and 2021.

In fact, the league’s investigation found that, as reported a few months ago, Dolphins owner Stephen Ross and partner Bruce Beal offered Brady “to become a partner with the Dolphins and possibly serve as an executive.” , although on occasion they also included the possibility that he would play for the Dolphins, ”says the NFL in its report.

The plan included coach Sean Payton, with whom they also illegally negotiated.

But why wasn’t Brady punished by the NFL?

Here’s the reason: the policy against these negotiations (rule that in English is known as “tampering”) forces teams to report any external talks with players or coaches.

The team that initiates the communication can be punished, but the player cannot. If the Dolphins approached Brady first, then they were the ones doing the tampering.

If the player is the first to approach, then the team is required to report it to the NFL.

Same reason Coach Payton won’t be punished either.

Instead, the league stripped Miami of two college picks, a first-round pick in 2023 and a third-round pick in 2024. In addition, Ross was fined $1.5 million and suspended until Oct. 17.

The Dolphins began talks with Tom Brady in August 2019, when he was still under contract with the New England Patriots. The communication was extended during the regular season and the Playoffs, in January 2020.

Those conversations were with Bruce Beal, but Ross and other Dolphins executives knew about it.

But, the Dolphins again had unauthorized communication with Brady and his agent during and after the 2021 season, when he was under contract with the Buccaneers.

“Those conversations began no later than early December 2021…Both Ross and Beal were active participants in those discussions,” the NFL reported.
